NEW RULE AFFECTING CDLs: On June 25, 2008, the U.S. Department of Transportation issued changes to its mandates on drug testing of some employees. The rule generally applies to testing of employees holding a commercial drivers license (CDL) and other transportation workers. Among other changes, the final rule considers it a refusal to test if the donor refuses to follow collector instructions during an observed collection process to raise and lower clothing as specified in its regulations. PROPOSED HEALTHY FAMILIES ACT: A new Ohio proposed law "Healthy Families Act" appears likely to go on the upcoming November ballot. If passed, this Act would require certain Ohio employers to increase their sick leave benefits to employees. Employers with at least 25 employees would have to provide employees a minimum of seven days of paid sick leave annually. Employees working at least thirty hours in a workweek would receive all seven days. Employees working less than 30 hours would receive a pro rata amount. Among other highlights of the proposed law, sick leave may not count under a no-fault attendance policy and employers could only require a doctors certification of leave if the leave period covered more than three consecutive days.
